Terms of Service
Terminology
For the purpose of this document, the following nomenclature will be used:

Cristina, known as a business under the name ¡Anchoa es Castilla!, the provider of services will be referred to as such, or as “Provider'', “Tutor” or “Teacher”.

Users of the service will be referred to as such, as well as "Users", “Students”, “Alumni” or “Clients”.
-
The services will be referred to as such, as well as “Class”, “Classes", “Lessons”, “Bookings”, "Hour" or “Services”. In the cases where repeated services are paid for in advance, they will be referred to as “Pack(s)”, “Package(s)” or “Lesson pack(s)”.
-
Students with paid, unfinished services, and students with finished services which have expressed intention to continue receiving the services, will be considered and referred to as “Active Students”.

The times mentioned will generally be those of London, United Kingdom, unless otherwise specified.
-
The currency used for business will be the British Sterling Pound (GBP), unless otherwise specified.
Below is a description of some of the characteristics of the services offered, by the Teacher, to students, as well as the conditions to receive and continue to receive them.
Agreeing to receiving the offered services, as well as receiving them, is understood as acceptance of the terms described as follows:​
1. Classes
General
1.1. Generally, and unless previously agreed differently, classes are private, meant for one (1) client, will take place in the format of a video conference, and their duration is of one hour.
1.1.1. The language used during the classes will be English, Spanish, or a combination of the two.
1.1.2. Classes with a significant language barrier, meaning, in which the student doesn’t have any previous knowledge of either of the aforementioned languages, may be considered, but not guaranteed.
1.2. The general availability for lessons is between 9:00 to 13:00; and 15:00 to 19:00. The lessons will be booked at the hour.
1.3. The videoconferencing platform will initially be determined by the Teacher, unless agreed otherwise. At the time of reviewing these terms, the main platform used will be Microsoft Teams, using other platforms such as Google Meet or WhatsApp alternative, if necessary.
Bookings
1.4. The date and hour will be agreed upon by both Parties before the lessons.
1.4.1. Lessons may be booked in one of the following ways:

Through cal.com, where Students can book directly using either of the links available at www.cal.com/anchoa; or
-
By arranging the booking directly with the Teacher during a consultation or Lesson, in which case the Teacher will confirm the Lesson on the spot.
1.4.2. Bookings offered or requested through email, instant messaging, or any other non-instant form of communication are not guaranteed, as the requested time slot may be reserved by another Student or Teacher before confirmation is received.
1.5. It is the responsibility of the Student to make sure there are available slots that suit them before paying for any services, which can be done using the Teacher’s online calendar in www.cal.com/anchoa/lesson.
Recurrence
1.6. Normally, classes will be provided on an on-demand basis within the options offered by the Teacher, meaning the student will decide how many classes they want to take, and how regularly. The tutor may make recommendations, but it is ultimately the decision of the student.
1.7. Whenever possible and available, lessons may be booked on a recurring basis, reserving a specific slot on a regular basis for a student. The slot will be reserved in this manner as long as:

1.7.1. The student is paying for the lessons in advance, as specified in these terms.

1.7.2. The student attends reserved lessons. A student can cancel in advance any number of recurring lessons, by expressing it in writing and providing a deadline for said cancellation(s). A recurring booking will be removed from the teacher’s calendar if a student doesn’t attend recurring lessons for a period of four (4) calendar weeks (when it’s outside of an informed deadline), or from the last completed lesson.
Packages
1.8. Lessons can be paid for individually, or in groups of 5 or 10, at a reduced price.
Special packages
1.9. From the 1st April 2026, a new type of lesson package will be available to existing students on an experimental basis. Their price will be reduced, but so will be their flexibility, and the terms of the lessons differ from the rest of the packages in the following areas:

1.9.1. The totality of the lessons purchased is booked between payment and the services themselves, either as a recurring event, an on-demand one or a mix between the two.

1.9.2. The minimum notice for students to cancel or change a lesson's time or day is one calendar week, counting from the time when the lesson is due. Any notice under this period will result in the loss of the class.

Technical issues aren’t included, as long as not thought to be used in a deceptive way.

1.9.3. The amount of lessons included in a package differ from the standard packages, as they have a one-monthly validity, and the amount of lessons is designed for a weekly basis across that month, except when either the Teacher or Student may be absent (on holiday, sick leave, etc.), where the packages will adapt to the circumstances.

1.9.4. These lessons are non-transferible.
Please note: the availability of these packages is not guaranteed in any way, in general terms or in particular ones. If the format doesn’t yield the desired results, they’ll be removed from offer.
Consultation and intro class
1.10. The first encounter between students and the teacher will be free of charge, will last one hour and it is divided in two main parts:
The first part consists of:
-
some general questions will be asked to the student, to better understand their needs and interests
-
assessing compatibility in terms of offer and demand
-
a brief description of the main terms and conditions of service (described at length in this document) will be explained,
-
clearing any doubts the student may have in relation to the service.
There is a questionnaire accessible on the website that the student can fill out before a consultation, in order to speed up the process and free up more time for questions and the “class” part of the consultation.
The second part consists of:
-
an unstructured class, to assess level, learning tendencies, interests, and other aspects relative to learning, to further help to personalise the content of the classes in the future.
In the case of those with no base knowledge, the class will remain unstructured, but with no assessment of previous knowledge.
Practice (homework)
1.11. To support what is seen in class, practical exercises (also referred to as “homework”) may be provided (optionally) at the end of the class.
These exercises are always considered voluntary.
Content used in class
1.12. Unless agreed or required otherwise, the Teacher will provide contents for the Classes, some of which will have been created by the Teacher, and will have the watermark reading “¡Anchoa es Castilla!” when in a visual format, and voiced by the teacher when in an audio format.
1.12.1. Unless otherwise specified or previously made public, this content is Intellectual property of the Teacher, intended for active and former alumni, and Students must obtain written or verbal confirmation by the teacher before sharing it elsewhere.​
2. Prices
2.1. Prices are set by the teacher, displayed on their website section "Prices" (www.anchoaescastilla.com/prices) and are subject to change at any time, with written notice.
2.1.2. Unannounced changes to pricing due to technical issues at any point in the process, for example, on the website or with the payment processor, do not apply and any payments not matching the rates will have to be corrected.
2.2. Fees can be paid via

The teacher’s website in the section “Prices”; via the service SquareUp, or Stripe in the case of individual lessons.

Bank transfer, of which details can be provided upon request. This can also be done via Revolut, which is the bank used by the Teacher.
2.3. The fee for classes and packages must be paid in advance, at least one day before the time in which the next class has been arranged. In the cases where a transfer takes time to be executed, proof of payment must be provided.
2.4. In the case of the packages of classes, the teacher will notify regularly of the remaining units and the last one.
2.5. Classes and packs can also be purchased as a gift.
Once lessons are paid for, who receives them is up for the client. The conditions being that:

any Students receiving lessons that some else pays for still have to go through the initial consultation.

It must be notified to the Teacher, in writing, including contact details, who will be receiving the lesson(s).
Validity
2.6. The student has a calendar year to use any paid for services, since the date and time of the payment.
2.6.1. If the circumstances of the student require an extension of this validity period beyond a year, the Student can notify the Tutor in writing to request an extension. Said requests need to have a proposed extension time, and the Tutor will then review and confirm. Extensions are not granted and are ultimately the decision of the Tutor.
Classes that have been arranged but have been cancelled within the appropriate cancellation window don’t count as completed, but “no shows” do, as they are removed from packages (see section "4. Non-attendance").
If a calendar year takes place without previous agreement between students and teacher to extend, the remaining classes will be forfeited.
2.6.2. In the event of a price increase, any remaining Lessons in Packages purchased by Students whose last Lesson occurred over six months prior to the change will be adjusted to the new rates, resulting in a reduction of the number of remaining Lessons.
No adjustment will be made if only one Lesson remains.
Unusual circumstances
2.7. In the case of death or disabling accidents happening to the Teacher, arrangements will be in place to return prepaid services that can no longer take place. In the case of Packages, refunds will be made for the remaining classes.
2.8. In the case of voluntary cessation of the previously provided services, all customers with pre-paid and pending classes will receive a written notification and be given enough time to make use of their purchased products.
2.8.1. If this cessation wasn’t voluntary, or didn’t allow time to use prepaid services, devolution of unused services will be arranged.
For example, if four classes remain from a 10 Class Pack, then the value at the time of purchase for those remaining classes will be reimbursed.
Payments from different countries
2.9. Unless otherwise agreed, all payments will be carried out in British Pounds (GBP) via the methods specified earlier in this section.
2.9.1. Students overseas who pay in different currencies and methods, will have to calculate the exchange rate at the time of payment, and any extra charges resulting from the exchange rate will be paid for by the student
Concessions
2.10. Exceptions to prices will be considered (but not guaranteed) for people who may need it, on a limited basis.
Special consideration will be taken for people who have fled armed conflict, refugees, survivors of domestic violence, etc.
3. Returns
3.1. After the purchase of an individual Lesson or a Package with no missing Lessons, a refund can be requested in writing during the fourteen (14) days from purchase. This request must also take place at least twenty-four (24) hours before the time and date arranged for a Lesson, or the first Lesson of a Package, if applicable (see “4. Non-attendance”).
3.1.1. If applicable, like in the cases using Square Up, from the total due to be reimbursed, any payment processing fees from third parties will be deducted.
3.2. Class packs missing classes cannot be reimbursed, but they can be transferred to someone else.
3.2.1. Finding the recipient of this transfer, as well as the financial transaction, are the responsibility of the student.
3.2.2. Once the necessary transactions have taken place, the initial student (who bought the package transferred to someone else) will inform the teacher, in writing, of who is receiving the remainder of the lessons.
3.2.3. Alternatively, the Student can donate them to the “common fund” where they will be donated by the Teacher to associations, auctions or individuals who can’t afford to purchase private lessons.
4. Non-attendance
4.1. When arranging a class date and time, it is understood that both parties (student and teacher) agree to be present at the time and date agreed.
4.2. The advance payment of a class or package acts as a deposit, and following are the circumstances in which a class/ deposit might be lost.
Student delays and no-shows:
4.3. If the student does not show up at the agreed platform/ place and at the agreed time, the teacher will attempt contact on alternative contact methods (agreed upon) in 5-minute intervals.
4.3.1. The lesson will be held for fifteen minutes (15) before being marked as a no-show, and therefore lost.
4.4. If the student informs the teacher in advance, they will have the chance to have a class during the remainder of the agreed Hour slot.
Recovering the lost time will be entirely at the teacher’s discretion and availability, and can’t be guaranteed.
Teacher delays and no-shows:
4.5. In the cases where the Teacher is late, the amount of time lost will be offered as an extension at any time where it is possible and agreed for both parts.
4.6. In some cases, at the teacher’s discretion, a partial refund for individual classes might be negotiated.
Cancellations
4.7. Cancellations, to be valid, must be in writing at least twenty four (24) hours before from the time the class is booked for. Cancellations carried out with enough notice do not incur in any lesson losses.
4.8. Cancellations taking place within the previous 24 hours of a Class, will be considered late cancellations and will result in the loss of the Class.
4.8.1. In some cases, a rescheduling may be offered by the Teacher, to prevent the loss of a class.
4.8.2. Students can notify the Teacher in advance and in writing of any ongoing circumstances that may result in a last-minute cancellation/ no show, and this will be taken as appropriate notice, provided it has a somewhat limited end indicated.
Technical issues
4.9. Technical issues are, in normal circumstances, an exception to the cancellation policy.
Due to the format in which classes take place, online and dependant on certain services and devices being operational, whenever a class is taking place, or meant to take place, and there are technical issues that impediment the course of the class on either end, out of the control of either the teacher or the student:
4.9.1. Different services or devices will be used, or,

4.9.2. In the cases where other devices or services aren't operational or available, or the nature of the technical issue prevents any contact (like a blackout), the Class will be forfeited and rescheduled with no penalisations.

4.9.3. In the cases where cancellations based on technical issues take place regularly, the teacher reserves the right to remove the exemption on this case, specially if suspected deceptive use or neglect. Since lessons are carried out online, it is the student’s responsibility to keep their devices operational enough so as to not cause repetitive disruptions.
Cancellation “score”
4.10. As acknowledgement of unforeseeable events, and in good faith, the teacher proposes the a “score” scheme, with the following conditions:
4.10.1. An attendance record is kept by the teacher in an individual log kept for each student.
4.10.2. The first two Student’s late cancellations or no-shows taking place won’t be lost/ deducted from a lesson package (Score “2”). Any deductions/ losses will start taking place from the third one (included) onwards (score “3” or more).
4.10.3. Every one of the Teacher’s late cancellations or no-shows with that student, which also get recorded, will subtract one of the Student’s, lowering their “score”. This allows the score to reach 0 eventually, allowing the two first “points” (Score “1” or “2”) to enable a free cancellations again eventually.
4.10.4. Active students or those with no more than a calendar month breaks, who haven’t had a late cancellation within a calendar year, get one point subtracted from their “score”. Students with breaks longer than a calendar month, the count starts from the date they resume having Lessons again.
4.10.5. For students, scores can be negative.
5. Conduct
5.1. Both Teacher and Student agree to maintain a professional, courteous, and respectful attitude at all times. Lessons are a collaborative space built on mutual goodwill, honesty, and consideration. Either party may discontinue the service if behaviour becomes disrespectful or disruptive to that atmosphere.
5.2. The Teacher reserves the right of refusal of service even if a payment has been made, without the right to a refund, in cases of gross misconduct or illegal actions carried out by the Clients.
5.3. Discriminatory comments on the subjects of sex, orientation, gender, disability, body shape or choices, race, cultural choices, religion, neurodivergences, mental health status, etc. will not be tolerated.
Discussions of Sensitive Topics
​5.5. Topics should remain academic, abstract, and linguistic in nature. As Lessons are designed to equip Students with an expansive vocabulary, students may request that topics of a current, political, or adult nature, be discussed, which will be up to the discretion of the teacher.
5.5.1. If the student is a minor (under 18 years old), discussions that may involve sensitive or adult topics will only take place with the written consent of a parent or legal guardian.
6. Privacy
Data collection and use
6.1. Teacher will abide by GDPR, which requires that retention of basic data is required to carry out the Services.
Data retention
6.2. The Teacher will retain the Student’s personal data only for as long as necessary to:
6.2.1. Provide teaching services and maintain accurate records of lessons, payments, and communications.
6.2.2. Comply with legal, tax, or accounting obligations.
6.2.3. Resolve disputes, enforce agreements, or meet any other legal requirements.
Personal data that is no longer needed for these purposes will be securely deleted or anonymised.
6.2.4. In general, data relating to lessons or payments will be retained for a period of up to six (6) years after the last lesson or financial transaction, in line with HMRC and standard record-keeping regulations, unless a longer retention period is required by law.
6.2.5. The Teacher may retain minimal contact details (e.g., name and email address) for professional correspondence or administrative purposes, unless the Student requests removal in writing, as outlined in clause 6.3.
Right to Erasure (Data Deletion)
6.3. A Student may request in writing the erasure of their personal data held by the Teacher. Such a request will be considered and fulfilled where applicable, in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The Teacher may decline or delay a deletion request if:
6.3.1. Erasure would conflict with legal obligations, such as record-keeping or tax requirements.
6.3.2. The data is controlled or processed by a third party (e.g. payment platforms, email providers) and is outside the Teacher’s reasonable power to remove.
6.3.3. The data is required to establish, exercise, or defend a legal claim.
6.3.4. Where data erasure is completed, the Student acknowledges that this may affect the Teacher’s ability to provide ongoing or future services, and that records of past transactions may not be recoverable.
Confidentiality
6.4. Both the Teacher and the Student share responsibility for handling information with care and respecting the privacy of others in all interactions, whether online or in person.
6.4.1. In group events—whether private or public, and whether held digitally or in person—Students are responsible for any personal information they choose to share or display during participation.
Examples include, but are not limited to:

When using shared classroom resources hosted on platforms such as Miro Board or Google Docs, account names may be visible to other users accessing the same document at the same time.

During live events on social media platforms (e.g. Instagram or YouTube), participant profile names or handles may be visible to others.
-
In private online events hosted via platforms such as Zoom or Microsoft Teams, participants’ names, profile information, and, where applicable, camera feeds may be visible to other attendees.
6.4.2. Students are encouraged to review the privacy settings of any third-party platforms used during classes or events.
6.4.3. A list of Software and Third-Party platforms used by the Teacher to carry out business can be provided under request, so that Students may review the relevant privacy and data policies of each service.
6.5. Confidentiality can not be guaranteed in cases where the law supersedes the right to privacy.
Security and Limitation of Liability
6.6. The Teacher is committed to protecting the privacy and confidentiality of all Students. Personal and contact information is collected, stored, and used solely for the purpose of delivering educational services and maintaining effective communication.
6.6.1. The Teacher takes reasonable and proportionate measures to maintain the safety and security of Students’ information, both physical and digital.
6.6.2. However, the Teacher cannot be held responsible for data breaches, unauthorised access, or other security incidents that are beyond her reasonable control or capacity to prevent.
Cookies
This section applies to all visitors of the Teacher’s website www.anchoaescastilla.com and any of its subsections.
6.8. The teacher’s website is hosted on Wix.com, which may collect cookies that help improve site functionality and performance. The Teacher has no control over cookies set by Wix or other third-party services.
6.9. More information about what cookies are and which cookies Wix uses can be found on the Wix "Cookies and your wix site".
7. Limitation of Liability
To the fullest extent permitted by law, the Teacher shall not be liable for any indirect, consequential, or incidental losses arising out of the provision or non-provision of services, including but not limited to loss of data, earnings, or opportunities. Liability for any claim shall be limited to the total amount paid by the Student for the specific services giving rise to the claim.
8. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. Both parties agree that the courts of England and Wales shall have exclusive jurisdiction.
9. Entire Agreement
These Terms constitute the entire agreement between the Teacher and the Student and supersede any prior understandings, whether oral or written.
